After a 10-day shutdown, maritime workers at Hutchison Ports Australia Sydney terminal returned to work with some of the most stringent COVID-19 measures in place, reports Kerry Smith.

“We're all very happy and proud of our efforts in this dispute: 106 days ago we didn't have a job and now we are going back inside,” a waterfront worker at the Hutchison Port Botany community assembly told Green Left Weekly on November 19. He was commenting on the settlement agreed between Hutchison management and the Maritime Union of Australia (MUA) to bring to an end conclusion the long-running industrial battle over the jobs of 97 workers sacked by text and email on the night of August 6.
The community assemblies at Port Botany in Sydney and Port of Brisbane continue to hold the line as the protracted process towards a settlement of the long-running dispute between Hutchison Ports and the Maritime Union of Australia (MUA) continues. On November 6, the dispute over the controversial sacking of 97 Hutchison waterfront workers by text and email reached its 92nd day.
A resolution of the long-running dispute between the Maritime Union of Australia (MUA) and Hutchison Ports is reported to be near, as the community assemblies continue at the terminals at Port Botany and the Port of Brisbane. A further hearing in Fair Work Australia is due in the week beginning September 21. The dispute began on August 6, with the midnight sacking by text and email of 97 waterside workers at the two ports. Following a Federal Court injunction, the sacked workers are back on the payroll, but are not being rostered on to work.
The Maritime Union of Australia (MUA) and Hutchison Ports management agreed on August 28 to sign a memorandum of understanding (MOU), which will result in all sacked workers at Port Botany and Port of Brisbane being reinstated for a further six weeks from August 31.

"We have won the first battle in a long war," Paul McAleer, Sydney secretary of the Maritime Union of Australia (MUA) told a rally of several hundred waterside workers and other unionists at the entrance to the Hutchison Ports terminal at Port Botany on the evening of August 13. He was speaking as news emerged of the important, if temporary, victory the union had achieved in winning a court injunction to order reinstatement of the sacked Hutchison workers in Sydney and Brisbane.

What do working people in a country like Australia need with trade unions or legal protections when employers in this country are so thoughtful as to email their workers at midnight to tell them they were sacked, as Hutchison Ports kindly did on August 6 to nearly 100 port workers in Sydney and Brisbane?
